USING SPECIAL EDUCATION LAWS TO COMBAT DISCRIMINATION
The Individuals with Disabilities Education Act (IDEA) guarantees a free public education (FAPE) for all children regardless of their level or any disabilities. If your school cannot or will not, then the parent has the right to sue the school district to provide private services at whatever cost those services might be. The law also provides for the reimbursement of attorney fees.
At The Cantrell Law Firm, we help parents of children with disabilities obtain the education services they are guaranteed under the law and fight discrimination against special needs children.
Your Rights Under the Individuals with Disabilities Education Act (IDEA)
The Individuals with Disabilities Education Act ensures assistance to children with disabilities. The law requires public schools create an Individualized Education Program (IEP) for each student who is found to be eligible. Schools may also be required to pay for medical services such as speech therapy, audiology, and physical therapy if necessary to help the student's education.
Attorney Dail Cantrell was an administrative law judge for special education for six years. He became an advocate for parents with special needs children after his and his wife's special needs son was born. Dail is director of legal services for Campbell County Schools and is a school board member in Anderson County. He has taken more than 200 cases to trial, and won nearly all of them.
Discrimination Claims Filed by a Special Education Student

As the father of a special needs child and a special education administrative law judge for six years, Attorney Dail Cantrell knows the issues that you deal with on a daily basis to ensure your child receives a proper education. You should not have to deal with anyone discriminating against your child and depriving him or her of a chance at a good education. An experienced litigator, Dail Cantrell and the rest of our Clinton education law attorneys can investigate your discrimination claim and build a strong case. We may be able to use the Individuals with Disabilities Education Act and other anti-discrimination laws to hold school officials accountable.
